Quite often we get asked what constitutes a holiday sickness claim and hopefully the guidance

within this post will help you to understand if you may be entitled to compensation for illness when abroad.

 

If you have been on an all-inclusive package holiday within the last three years and suffered illness, you could be entitled to make a holiday sickness claim.  The types of illness on holidays caused by poor hygiene and poor food preparation and storage are Botulism, Campylobacter, Clostridium Difficile, E. coli, Listeria, Salmonella, Typhoid.

Get the compensation you deserve

You may be eligible to receive holiday sickness compensation if you suffered from the following symptoms after eating food included in your all-inclusive package:  nausea, vomiting, diarrhoea, abdominal pain, loss of appetite, raised temperature, muscle aches.

If you have eaten food not included in your packaged holiday and have subsequently become ill, your case will be more difficult to prove, as in order to receive holiday illness compensation, a holiday illness solicitor must prove on the balance of probabilities it was the food provided by the tour company / hotel that caused your illness.

It is very useful in proving your case if you have in some way reported your illness  – e.g. to the hotel, to a tour operator representative, to your doctor or hospital, so keep a record of any doctors notes, prescriptions or meeting with your tour operators as these may be required for your case. Also, if you have taken any medication for the illness which you purchased on holiday, if you have retained the packaging of the medication, this will assist your solicitor also.
